Understanding the New Towns and Local Service Districts Act

Change is in the air—and not just in our weather! Recently, the Government of Newfoundland and Labrador introduced the new Towns and Local Service Districts Act. This new legislation replaces the old Municipalities Act and changes how Local Service Districts (LSDs) like ours operate.


As your LSD Committee, we wanted to highlight a few key changes that help us serve Mobile better.


1. Clearer Powers and Responsibilities

The new Act provides a more modern framework for how we manage our community. It clarifies that the LSD Committee is a corporation with the power to enter into contracts, manage staff, and oversee essential services. This makes it easier for us to move forward on local projects with clear legal standing.


2. Mandatory Services: Keeping Mobile Clean

One of the most significant sections (Section 257) reinforces that garbage collection and removal is a mandatory service. While we’ve always prioritized this, the Act makes it clear that the committee must ensure a system is in place—whether we manage it ourselves or contract it out—to keep our community clean and healthy.


3. Enhanced Financial Accountability

The Act introduces stricter guidelines for our budgets and financial reporting (Sections 245 & 246).

  • Annual Budgets: We are required to prepare and submit a balanced budget every year.

  • Audits: There is a stronger emphasis on audited financial statements to ensure every dollar of your service fees is accounted for and spent wisely on our community.


4. Modern Meeting Rules

The way we govern is catching up with technology! The new Act officially allows for meetings to be held via electronic means (like Zoom, Meet or Teams) when necessary, making it easier for committee members to stay connected and for the community to stay informed.


5. By-Law Authority

The new Act (Section 266) gives LSDs the power to make by-laws regarding the services we provide. This is a vital tool for ensuring that our local regulations, like those concerning our water systems or waste management, are enforceable and fair for everyone.

These changes aren't just about paperwork; they are about transparency and resilience. By having a clearer legal structure, the Mobile LSD can be more efficient, more accountable, and better prepared to protect the unique character of our community.
